This Privacy Policy explains how MobileUza collects, uses, shares and protects your personal data when you use our online marketplace (the "Platform"). We are committed to handling your information responsibly and in line with the Data Protection Act, 2019 of Kenya and the guidance of the Office of the Data Protection Commissioner (ODPC).
MobileUza takes no online payment. Buyers pay sellers directly, so we do not collect or store any card numbers, bank details or other financial-account data, and there is no escrow. The personal data we handle is limited to what is needed to run the marketplace and to pass your order to the store you buy from.
1. Who we are (the data controller)
The data controller responsible for your personal data is Cowrietech Limited, trading as MobileUza, of Jahazi, Lavington, Nairobi, Kenya. Where we are required to register with the Office of the Data Protection Commissioner (ODPC), we comply with that obligation; our current registration details are available on request.
2. Categories of personal data we collect
- Account & registration details — name and the credentials you set when you create an account.
- Contact details — phone number and, optionally, email address.
- Order & delivery details — the items you order, delivery address or pickup preference, and any delivery note or instructions you provide.
- Device & usage data — technical information such as your IP address, browser type, pages viewed and interactions, collected to keep the service secure and working.

You can browse the Platform without an account; some details are only collected when you place an order.
3. Our data-protection principles
We handle your data lawfully, fairly and transparently; we collect it only for the specific purposes below; we keep it accurate and up to date; we limit what we collect to what is necessary; we keep it no longer than needed; and we protect it with appropriate security. These mirror the principles set out in the Data Protection Act, 2019.
4. Why we use your data (purposes of processing)
- To provide and operate the marketplace and let you browse stores and products.
- To create and fulfil your orders, including passing them to the relevant store.
- To manage your account and keep you signed in.
- To provide customer support and respond to your queries.
- To understand how the Platform is used (analytics) so we can improve it.
- To detect, prevent and investigate fraud, abuse and security incidents.
- To comply with our legal obligations.
- With your consent, to send you optional marketing or updates (you can opt out at any time).
5. The legal bases we rely on
- Performance of a contract — to create and process the orders you ask us to place.
- Legitimate interests — to keep the Platform secure, prevent fraud and improve the service, balanced against your rights.
- Legal obligation — where the law requires us to keep or disclose certain records.
- Consent — for optional marketing and for non-essential cookies; you may withdraw consent at any time.
6. Who we share your data with
We do not sell your personal data. We share it only as needed to run the service:
- The seller / store you order from — when you place an order, we share your name, contact details, order contents and delivery information with that store so it can confirm, prepare, deliver and contact you about your order. The store is an independent business and uses your details to fulfil that order.
- Hosting & cloud providers — who store and run the Platform on our behalf.
- Email & SMS delivery providers — who send order confirmations and notifications on our behalf.
- Law enforcement or regulators — where we are legally required to disclose information, or to protect our rights, users or the public.
We require service providers to protect your data and to use it only for the services they provide to us.
7. Cookies & similar technologies
We use a strictly necessary session cookie to keep the Platform working (for example, your session and cart) and, with your consent, may use analytics cookies. You can manage your choice through the cookie banner and your browser. Full details are in our Cookie Policy.
8. How long we keep your data (retention)
We keep personal data only for as long as it is needed for the purposes above — for example, to fulfil and support your order, to keep your account active, and to meet legal, accounting and fraud-prevention obligations. When data is no longer needed, we securely delete or anonymise it.
9. Your rights
Under the Data Protection Act, 2019 you have the right to:
- access the personal data we hold about you;
- ask us to correct inaccurate or incomplete data;
- ask us to delete your data where there is no overriding reason to keep it;
- object to certain processing;
- withdraw consent at any time (this does not affect processing already carried out);
- opt out of marketing at any time.
To exercise any of these rights, contact us using the details in section 13. We may need to verify your identity first. You also have the right to lodge a complaint with the Office of the Data Protection Commissioner (ODPC) if you are unhappy with how we handle your data.
10. How we protect your data (security)
We use appropriate technical and organisational measures to protect your data — including access controls, encryption in transit, and limiting who can see personal data. No system is perfectly secure, but we work to keep your information safe and to respond promptly to any incident.
11. Children
The Platform is intended for users aged 18 and over. Children under 18 may only use MobileUza under the supervision and with the consent of a parent or guardian. We do not knowingly collect data from children without that consent; if you believe we have, please contact us so we can remove it.
12. International transfers
Your data is primarily processed in Kenya. If any service provider processes data outside Kenya, we take steps to ensure it remains protected to a standard consistent with the Data Protection Act, 2019.
13. Changes to this policy & how to contact us
We may update this Privacy Policy from time to time. The "Last updated" date at the top shows when it last changed; significant changes will be highlighted on the Platform.
